Events company:

This is event is run and owned by the LUMA Light Festival Trust (also known as the Promoter or LUMA).

Terms and Conditions are Binding:

Tickets to the Event are sold or given, and admission to the Event is granted on the express condition that you are bound by these Event Terms and Conditions and any other rules and regulations issued by the Promoter (Event T+Cs). By purchasing an Event ticket you agree to be bound to the Event T+Cs.

Directions of Event Staff:

You must follow the reasonable directions of Event staff as required and comply with the law at all times during the Event.
There are licenced undesignated hospitality areas at the event. You must have valid proof of age photo ID to purchase alcoholic beverages in the licenced areas. Persons under the age of 18 years will be denied service. 

Event Tickets: 

Entry to the Event Site will be granted with presentation of:

  • a valid bar-coded ticket; or
  • a valid bar-coded print-at-home PDF ticket; or
  • a valid bar-coded Passbook ticket (electronic ticket on mobile device).

Issued by an Authorised Ticketing Agency.
Damaged or defaced Event tickets will not be accepted.

Entry to the event will be until 9:30pm each event day. After 9:30pm, there will be no entry to the event.  The event will finish at 10:00pm each event day.

Event Tickets will be used to scan at the exit if the customer plans to come back on the same day, passouts will be available till 9:00pm.

An Authorised Ticketing Agency means each of: (1) Flicket Ltd (Flicket); and (2) any independent ticketing outlet as authorised and approved by the Promoter. Lost Tickets: replacement is not available for lost, destroyed or stolen Event tickets unless proof of purchase is presented. 

Ticket Restrictions: 

  • You agree not to re-sell Event tickets contrary to applicable laws. Event tickets may not, without the prior written consent of Promoter;
  • be re-sold or offered for resale at a premium (including via online auction sites) or;
  • used for advertising, promotion or other commercial purposes (including competitions and trade promotions)

 or;

  • used to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. If an Event ticket is used in breach of this condition, the Event ticket may be canceled without a refund and the bearer of the Event ticket may be refused admission. The Promoter will use reasonable efforts to notify you of such action.

Ticket Purchase Limits: 

The Promoter reserves the right to enforce published ticket purchase limits and cancel any tickets obtained above said limits in any one transaction or by any one customer. If you exceed the stated ticket limit, you may have all or any of your order and tickets cancelled without notice by the Promoter at its discretion. This includes orders associated with the same name, email address, billing address, credit card number or other information.

Restricted Capacity: 

You acknowledge that there may be restricted capacities at some of the Event’s stages or venues. Once the maximum capacity is reached in these areas there will be no further admissions. Your purchase of a ticket to the Event does not guarantee admission to these areas in such cases.

Passouts: 

Passouts will be issued from 5:30pm – 9:00pm each event day, these will be provided by passing through the correct exit to obtain a passout scan on the individual ticket.

Refund and Cancellation Policy: 

The Event is an all-weather event. Assuming the Promoter and identified stakeholder deem it safe to do so; the Event will take place rain, hail or shine. Tickets purchased for the event are for the LUMA, not for specific artists or performances. The Promoter reserves the right to change, add, withdraw or substitute installations and performances in the Event line-up, vary the advertised program, vary the date and/or vary the Event Site without prior notification and deny admission to the Event Site (including admission to a particular performance at the Event Site) with reasonable cause. No refunds on tickets except where required by the Consumer Guarantees Act 1993. No refunds or other compensation will be given if an advertised artist or act is changed, cancelled or the length or content of their performance is changed.

Subject to this clause, the Promoter is not liable for any loss, damage or compensation as a result of the Event being cancelled, postponed, relocated or changed for any reason.

There will be no refund of any unused portion of an Event Ticket if you or your invitees are asked or forced to leave the Event for any of the reasons set out in the Event T+Cs or if you decide not to attend the Event. You are responsible for checking the age minimum for the Event. 

LUMA 2024 Ticket Refunds are available until 16th May and the face value of the ticket will be refunded.

If you would like to change the date you are attending LUMA, you will need to re-purchase a new ticket.

If you are no longer needing your child tickets for a specific day, ensure you email support@flicket.co.nz 

Search on Entry: 

At the point of entry you may be asked for a search of you and/or your possessions be required. If you do not consent to such searches, you may be denied entry to the Event Site without refund. Prohibited Items include but are not limited to the list of items at the end of these Event T&Cs and any Prohibited Items will be confiscated.

Confiscated items will not be returned, replaced or reimbursed and proceeds from confiscated items (if any) will be donated to a charity. Promoter reserves the right to refuse entry to any persons.

Smoking Policy: 

LUMA (Queenstown) Southern Light Project is a smoke free event.

Photographing and/or Recording Disclaimer: 

When attending LUMA, you enter into a designated  area where photography, audio, and video recording will occur. LUMA reserves the right to use any imagery/recordings taken at the event, without expressed verbal or written permission. LUMA may use any appropriate footage (photography/video/audio recordings) in publications or other media material produced including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, social media etc.

To ensure the privacy of individuals and children, images will not be identified using full names or personal identifying information without written approval from the photographed subject, parent or legal guardian.

Anybody attending  LUMA who does not wish to have their image recorded for distribution should make their wishes known to the event organisers in person, or by email to connect@luma.nz within 7 days of the event finishing.

By participating in LUMA by failing to notify the LUMA management team by email your desire to not have your photograph used in marketing material, you are agreeing to release, defend, hold harmless and indemnify  LUMA from any and all claims involving the use of your picture or likeness.

Any person or organisation not affiliated with LUMA may not use, copy, alter or modify LUMA photographs, graphics, videography or other, similar reproductions or recordings without the advance written permission of an authorised designee from LUMA.

An person or organisation not approved by LUMA Management or LUMA Capture must not collate images, videos or recordings for commercial use. 

No Animals: 

Pets are not permitted at the Event due to the scale of the event’s lighting and sound effects and capacities. Service animals are Permitted.

Your Behaviour: 

You must ensure that you and your invitees act in an orderly manner when attending the Event Site. the Promoter may refuse entry or evict you or any of your invitees if you or any of your party are behaving in a disorderly, offensive or inappropriate manner.

Alcohol: 

The Event has licenced undesignated hospitality areas – please do not bring alcohol with you as it will be confiscated and will not be returned. Only alcohol purchased from the licensed areas at the Event may only be consumed within that area. If you wish to purchase or consume alcohol, you must have valid proof of age photo ID. You must be of legal age (18 years) to purchase and consume alcohol on the Event Site. If you are found supplying or buying alcohol for a minor (a person under 18 years of age) you will be evicted from the Event and may be referred to police.

Food and Drink: 

Food and non alcoholic drink is permitted into the Event Site. Water bottles and drinking cups and take away containers are encouraged to align with our sustainability policies however any alcoholic beverages will not be allowed to be taken out of the licenced areas in any vessel.

Drugs: 

If you are found supplying, consuming or in possession of illicit drugs you will be removed from the Event Site and may be referred to police.

Signage: 

You are not permitted to display trading signs on the Event Site without prior written consent of the Promoter.

Your Personal Information: 

Pursuant to your booking, Promoter may need to collect and keep personal information about you including your name, address, credit card or payment details, telephone number and the names of all ticket allocations. Unless you tell us otherwise, Promoter may disclose your contact details to third parties if you elect to receive such information at time of ticket purchase so they can provide you with promotional material about other LUMA events and products. The Promoter may also need to disclose your personal information as required by law or as permitted under the Privacy Act 1993. If you have any questions about how Promoter will handle your personal information please contact connect@luma.nz. Please note that all payment information is handled by Stripe and subject to their T+C, no information on Credit Cards is collected or stored by Flicket Ltd.

Promoter’s Liability: 

The services provided by Promoter will be rendered with due care and skill to the extent required by Part 4 of the Consumer Guarantees Act 1993. Apart from such statutory liability, Promoter and the owner and/or lessee of the Event Site will not be liable or responsible for any injury, damage or loss suffered or incurred by you or any person entering or when you enter or are on the Event Site whether caused by the negligence of Promoter or that of the owner and/or lessee of the Event Site (or their respective employees, contractors or agents), whether arising in tort, contract, bailment or otherwise – all such injury loss or damage to person or property is at your own risk.

Indemnity: 

You agree to indemnify Promoter and owner and/or lessee of the Event Site against any loss or damage  Promoter and/or Event Site owner and/or lessee may suffer arising out of your negligence or breach of the Event T+Cs.

Release: 

To the full extent permitted by law, you waive all legal rights of action against and fully release Promoter and owner or lessee of the Event Site (and their respective executive members, directors, officers, employees, volunteers, contractors or agents) from any liability for any loss, damage, personal injury, death, economic loss or consequential loss for any default, failure or negligence (to the extent permitted by law) in relation to entry to and presence on the Event Site.

Risk: 

Entry to the Event Site is at your own risk. Without limiting the generality of this:

  • appropriate footwear and clothing must be worn at all times at the Event Site;
  • ear plugs should be worn if necessary.

To the extent permitted by law, Promoter takes no responsibility for any hearing damage or loss caused by excessive noise or injury caused by your failure to follow Promoter’s directives. In the event of injury or illness Promoter may, at your cost, arrange medical treatment and/or emergency evacuation as deemed essential for your safety.

Enforceability: 

Any provision of these Event T+Cs which is or becomes unenforceable shall not invalidate the other provisions of these Event T+Cs.

Environment: 

Promoter cares for the environment and community. Please be respectful and place any litter in the bins provided around the Event Site.

Covid-19: 

The parties acknowledge that, as at the time of purchase, there is a respiratory outbreak caused by Covid-19 that is impacting New Zealand. The parties agree that where it is impossible or impractical for the performances to take place due to any cause or event in connection with Covid-19 pandemic that is not reasonably within the control of the promoter, then the Performance will be cancelled and the parties will have no further liability to each other, the ticket purchaser will be refunded any monies paid to the promoter less any booking fees paid to the ticket agent and credit card fees paid to the ticket purchasers bank.

Prohibited Items: 

Prohibited Items include but are not limited:

  • Alcohol – any alcohol found at the Event Site will be confiscated and will not be returned and the offending patron(s) ejected from the Event Site for the remainder of the Event.
  • Air horns.
  • Weapons or explosives of any kind (including potential missiles).
  • Illegal substances.
  • Animals (excluding service dogs such as guide dogs and police or emergency service dogs).
  • Nitrous oxide bulbs and canisters.
  • Flares, fireworks, sparklers explosives, or any fire twirling equipment.
  • Fires and open flames.
  • Flammable liquids.
  • Instruments.
  • Sound systems.
  • Portable laser equipment and pens.
  • Sharpies, markers, paint cans or paint pens.
  • Drones or other remote control devices.
  • Couches and chairs.
  • Anything studded (ie belts, wristbands etc).
  • Audio or video recording devices (including GoPro and similar).
  • Professional photography equipment (eg telephoto lenses; any lens over 20cm; any detachable lens; stands or other commercial equipment or anything deemed by Event staff to be professional photography equipment).
  • Kites or sky lanterns.
  • Toy guns, water guns or slingshots.
  • Monopods, tripods or attachment sticks(selfie-sticks).
  • Unauthorised solicitation materials including handbills, flyers, stickers, beach balls, give-aways, samples, or other promotional items.
  • Any other item deemed by Event staff (in their discretion) to be dangerous or offensive or potentially dangerous by Event organisers.
  • Eskies and coolers.
  • Umbrellas.

Promotion Specific Terms

Win A Trip For Two To: LUMA Southern Light Projet in 2024

LUMA Light Festival Trust (the “Promoter”) offers you the opportunity to win one (1) trip for two people to Queenstown, New Zealand. Simply pre register before March 1st 2024

Promotion period

The Promotion opens at 9am 1 December 2023 and closes at 5pm, 10 March 2024 (the “Promotion Period”).

How to enter

  1. To enter the Promotion, participant agencies must:
  2. Be eligible under the Standard Promotion or Competition Rules below; and
  3. Pre register for LUMA 2024 ticket sales.

LUMA Light Festival Trust pre-regrester include through the sigh up portal on the LUMA website (www.luma.nz).

To be in the draw to win, participants must pre register before March 1st, 2024.

The prize consists of one (1) trip for two to Queenstown, New Zealand, including 2 x LUMA tickets, airfares and accommodation as follows:

  • Two (2) tickets to one night at LUMA
  • Two (2) return economy class flights from a major center in New Zealand to Queenstown, New Zealand;
  • Two (2) nights’ accommodation in Queenstown at Crowne Plaza Queenstown secured by The Promoter (the “Prize”).

Prize and travel criteria

  1. Peak travel periods are excluded.
  2. Flights and dates are subject to availability.
  3. Flights and accommodation will be booked by the Promoter and will be selected at its discretion.
  4. All additional costs including travel insurance, lounge access, travel upgrades, food, alcoholic beverages, spending money, other transfers, departure taxes (if any), connecting flights and other incidentals are not included in the Prize and are the responsibility of the Prize winner (the “Winner”) and their travel companion. Please see Rule 21 of the Standard Promotion or Competition Rules below for more information.
  5. The Prize winner and travel companions are strongly encouraged to obtain travel insurance for the duration of the trip prior to departure. It is the responsibility of the Winner and their travel companions to ensure such travel insurance protects them, to the greatest extent possible, from any costs associated with contracting COVID-19, government lockdown, change in travel bubble rules, or changes in rules related to flying. The Promoter is not liable for any fees, costs, damages, or payments required to be paid as a consequence of COVID (or related matter) or associated rules, laws, government directives, or otherwise. The Prize winner and travel companions agree and accept that travel is taken at their own risk.
  6. All competitions that involve flights must be from a main centre in New Zealand with direct flights to Queenstown

Winning the prize

  1. The Prize Winner is deemed to be the Winner that has entered the winning entry in the Competition and the travellers are the two names included in the winners winning entry
  2. The Prize winner will be selected by the LUMA Light Festival Trust (Promoter)
  3. The Prize winner will be contacted by the Promoter via email within 10 working days of the competition’s closing date.
  4. If the Promoter is unable to contact the entrant drawn, the Prize is forfeit and the Promoter may select another Prize winner.
  5. The Prize delivery details will be arranged directly between the Prize Winner and the Promoter and are subject to the Prize winner promptly providing the Promoter with all information requested.
  6. The Prize is non-transferable, exchangeable or redeemable for cash.
  7. There will be one (1) Prize Winner, who will win the Prize.
  8. Where the Winner and their travel companion are unavailable or unable to travel on the relevant dates, no alternative prize or travel dates will be offered and the Prize will be forfeited.
  9. The Promoter reserves the right to select another Prize Winner
  10. The Prize Winner and travel companion will at all times act responsibly so as not to harm the reputation of the Promoter while taking up the Prize.

Other

  1. These terms and conditions may be amended, and the Promotion terminated at any time by the Promoter.
  2. The Promoter’s decisions on all Promotion matters are final and no correspondence will be entered into.
  3. Participants grant the Promoter permission to use creative material from entries submitted in the Competition for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use. This includes the right to use on the Promoter’s websites, social medial channels, on air, and other publications of the Promoter.
  4. Participants grant the Promoter permission to use their name, photograph, voice and film recordings in which they appear, in connection with the Promotion and for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use. This includes the right to use on the Promoter’s websites, Facebook pages, on air and other publications of the Promoter.
  5. The Winner and their travel companion consent to the Promoter sharing their personal information with all travel service providers for the purpose of delivering the Prize.
  6. Any personal information provided to the Promoter will be collected, held and used in accordance with the Promoter’s privacy policy.
  7. The Promoter will collect and use, for the purpose of the Promotion, your personal information. You have the right to request access to and correction of your personal information (where such information is readily retrievable) by contacting the Promoter (connect@luma.nz).
  8. Attendance of the Prize Winner’s and their travel companion on the Prize is subject to the terms, conditions and restrictions of the airline carrier, the accommodation provider and any other third-party service providers. The Prize Winner and travel companion agree to comply with all terms and conditions and any reasonable instructions given by such third parties.
  9. Other conditions may apply and will be advised at the time of booking.
  10. The Promotion is subject to these Specific Terms and the Standard Promotion or Competition Rules below.
  11. By entering this Promotion you have agreed to accept these terms and conditions, LUMA’s website terms of access and privacy policy.

Standard promotion or competition rules

Definitions

‘LUMA’ means LUMA Light Festival Trust.

The ‘Promoter’ is LUMA Light Festival Trust.

‘Disqualified Participants’ are:

(a) all LUMA employees, all employees of participating sponsors or promoters and/or advertising agencies and their Immediate Families;

(b) all people under the age of 18 years where the prize incorporates air travel or any other element which would be illegal to supply to a person under the age of 18 years, unless traveling with a guardian;

(c) all people who have won a prize from this promotion in the last 14 days. If the previously won prize was valued at over $1000 the winner must stand-down from entering for a period of 90 days.

‘Immediate Families’ include spouses, grandparents, parents, children, and grandchildren, whether by marriage, past marriages, remarriage, adoption, co-habitation or other family extension.

Entry

  1. These Promotion or Competition Rules (‘the Rules’) apply to all LUMA Promotions or Competitions (collectively the ‘Promotion’) conducted on or off air and by means of any medium – online , radio, print, or a connected device. The Rules may change from time to time.
  2. If a particular Promotion has specific rules or terms (‘the ‘ Specific Rules’) those Specific Rules will apply if there is any inconsistency with the Rules.
  3. Unless otherwise stated in the Specific Rules registration, entry or vote is limited to 1 per person. Where multiple registrations, entries or votes are acceptable, each must be made separately.
  4. Entry into the Promotion is deemed to be acceptance of the Rules and the Specific Rules and confirmation that the entrant has the necessary authority (for example from the bill payer or owner of a telephone) to enter the Promotion.
  5. No purchase is necessary to win or participate in the Promotion, unless specified in the Specific Rules.
  6. The Promotion is open to New Zealand Residents only. Disqualified Participants may not enter in the Promotion.
  7. LUMA reserves the right to exclude any person from participating in the Promotion on reasonable grounds.
  8. LUMA reserves the right to refuse to award any prize to an entrant who LUMA decides (in its sole discretion) has violated the Rules (including the Specific Rules), gained unfair advantage in participating in the Promotion or won using fraudulent means.
  9. By participating, entrants grant LUMA exclusive permission to use their names, characters, photographs, videos, voices and likeness in connection with the Promotion and for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use.
  10. All entrant personal details must be valid and up to date and will be held by LUMA and may be used for the purpose of the Promotion and for future promotion and marketing purposes in accordance with LUMA Privacy Policy (see www.luma.nz) unless otherwise directed by contestants at the time of entry.
  11. Personal information provided at the time of entry is presumed to be true and, in the case of text or email notification – active, through to and beyond the date of the Promotion’s completion.
  12. You consent to LUMA sharing the personal information you have provided upon entry into this competition with third parties as required in order to provide the prize to you.
  13. Where the Promotion involves texting, the following apply:

a) Standard sms text charges will apply, unless otherwise stated in the Specific Rules and will depend on the entrant’s particular plan or agreement with their phone service provider;
b) Any form of automated text message is invalid;
c) The telephone number from which the entry was made will be stored in a database. The entrant has a two-business-day period from the time of entry to request removal from the database. If no request is made it is deemed acceptance that the information can be used for future promotion and marketing purposes; and
d) LUMA takes no responsibility for text costs incurred after the Promotion has closed as stipulated in the Specific Rules.

  1. Winning the Prize

  2. Only the person who originally entered the Promotion can be awarded the prize (the ‘Winner’).
  3. The Winner will be determined in the manner set out in the Rules or the Specific Rules – if not specified then as determined by the Promoter who shall for this purpose be deemed the judge (the ‘Judge’).
  4. The Judge’s determination of the Winner will be final and no correspondence will be entered into.
  5. The Winner will be notified by email, phone (voice or text), mail or in person and must be available for the preparation of all publicity that may be required by LUMA. Where attempts to contact the Winner fail (eg when the Winner cannot be contacted by phone after three attempts or mail sent is returned) the Judge will select another winner. If, after successful notification, the prize is not collected within two months of being announced it will be regarded as forfeit. (Note: 3 attempts to contact the Winner will include individual calls to any numbers provided at the time of entry. However, should the prize’s total worth equal less than NZD$250 and be a live-to-air draw, only one failed attempt at contact will be acceptable before the Judge selects another winner.)
  6. The Prize is not redeemable for cash or transferable. No other family members, friends, office associates or any other person will be able to participate on the Winner’s behalf. In the event that the Prize specified in the Competition becomes unavailable for any reason the Promoter may substitute a prize of like or equal value.
  7. Where the Winner is required to claim the prize in person, they must provide proper identification (e.g. driver’s licence, passport, birth certificate). If the Winner is under the age of 18 years their parent or legal guardian must accompany the Winner or give their prior written consent to the award of the Prize.
  8. The Winner takes the Prize entirely at his/her own risk and indemnifies LUMA in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with the prize. The Winner is responsible for all insurance, tax or other costs that may be associated with the Prize. Where the Prize has associated terms and conditions the Winner accepts the Prize subject to those terms and conditions and restrictions.
  9. Where the Prize includes air travel and/or accommodation, either international or domestic (the ‘Travel Prize’):

(1) the Winner MUST have valid documentation, including but not limited to valid passports and Visas, which meet the requirements of immigration and other government authorities at every destination.

(a) Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities (including any costs associated with delay, will be the sole responsibility of the Winner).

(2) The Winner and their travelling companion (if applicable) must travel together at all times. The Winner is responsible for transport from their residence to their nearest main centre domestic airport for flight departure and from their nearest domestic airport to their residence.
(3) Flight tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. The flight itinerary may have to be adjusted depending on the airline’s departure city and their current flight schedule. Unless otherwise specified, the air travel is economy class.
(4) Any changes to travel dates or additional accommodation outside the travel period specified in the Travel Prize details, made by the winner, which incur additional costs, are to be paid by the Travel Prize winner.
(5) Unless explicitly stated in the Specific Rules, the Winner will be responsible for expenses including, but not limited to, spending money, meals, drinks, transport, laundry charges, activities, incidentals, taxes (excluding departure and any other flight associated taxes included within the Travel Prize), gratuities, services charges, passports, visas, travel insurance and all other ancillary costs associated with redeeming the Travel Prize. The Winner must obtain travel insurance to protect themselves against additional costs incurred in the event of unforeseen circumstances.
(6) The Travel Prize is not transferable or exchangeable and cannot be redeemed for cash. The Travel Prize must be taken as stated in the Specific Rules and no compensation will be payable if the Winner is unable to use the Travel Prize as stated. For the avoidance of doubt, if the Winner is, for whatever reason, unable to travel on a nominated date during this period, whether the failure was due to reasons beyond the Winner’s control or otherwise, then the Winner will forfeit the Travel Prize.
(7) The Promoter makes no representation as to safety, conditions and other issues that may exist at any destination. Domestic travel advice can be obtained from various sources, including government, local consular offices and this web site www.newzealand.com/in/domestic-flights/. The winner accepts the Travel Prize at their own risk.
(8) All travel is subject to the terms, conditions and restrictions of the Travel Prize service providers. Any travelling companion included in the Travel Prize (if applicable) accepts the Travel Prize subject to these terms, conditions and restrictions as if references to the Winner in the relevant clauses were to the travelling companion. 

LUMA Responsibility

  1. LUMA reserves the right to amend, vary, extend or discontinue a Promotion at any stage, for any reason.
  2. LUMA takes no responsibility for any inability to enter, complete, continue or conclude the Promotion due to equipment or technical malfunction, busy lines, inadvertent disconnection, texts with a misspelt keyword, texts to an incorrect shortcode, Force Majeure or otherwise.
  3. To the fullest extent permitted by law LUMA will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for personal injury as a result of Promotion entry or winning the prize.
  4. Where the Prize is to be supplied by an entity outside LUMA’s control and that entity fails, for whatever reason, to supply the prize, LUMA has no responsibility for the provision of the Prize and is not obliged to provide an alternative Prize or to take legal action to require the Prize supplier to provide the Prize.
  5. Acceptance
  1. Participation in the Promotion is deemed acceptance of these Terms and Conditions.
  2. If the Winner does not accept these Terms and Conditions the prize will be forfeited.
